Terms and Conditions

The following terms and conditions are the stipulations which one must abide by in order to use all of Young Voices’ services.

Terms and conditions are governed by English law. You and Young Voices both agree to submit to the non-exclusive jurisdiction of the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

Young Voices reserves the right to change or alter these terms at any time.

Young Voices or YV is the trading name of Young Voices (UK) Ltd.

YV and Place2Be charity wristbands

Young Voices will sell a charity wristband. All profits of wristbands sold will be donated to the charity, Place2Be. This will be a minimum of 50p per wristband. YV will ensure that the following statement is displayed 'All profits of every wristband sold will be donated to Young Voices’ charity partner Place2Be'. Place2Be is one of the leading children’s mental health charities in the UK, and this donation will support vulnerable children in schools across the UK. This will also be displayed on the company’s online shop when a consumer adds a charity wristband/s to their basket during the Promotion Period.

YV Website Terms and Conditions

1. Information about us, our website and these terms

At Young Voices, we run the largest children’s choir concerts in the world. Our Website enables you to learn more about what we do, to register schools to take part in one of our concerts, to access the resources we offer as part of the concert experience and to buy Young Voices merchandise, tickets for our concerts and memorabilia such as digital footage from our concerts.

This page sets out the terms and conditions that apply to use of our Website and the various resources available in it. These Terms are broken down into sections which may or may not apply to you, depending on which areas of our Website you are accessing.

Sections 1 – 5 apply to all users of our Website.

Section 6 applies, in addition to sections 1-5, to Schools and their staff who access the Teacher Centre.

Section 7 applies, in addition to sections 1-5, to users who access the Young Voices Music Room.

In these terms, the following words have the following meanings:

Intellectual Property Rights” means the rights in and to our creations. There are lots of different categories of intellectual property, and where we refer to “Intellectual Property Rights” in these Terms this includes (but is not limited to) copyrights, moral rights, trade and service marks, domain names, rights in designs, rights in databases and know-how, whether or not we have registered these rights, as well as all similar or equivalent rights and forms of protection existing anywhere in the world.

Music Room” means the ‘Music Room’ area of the Website.

School” means any school registered with Young Voices.

Teacher Centre” means the schools registration and teacher resources area of our Website.

Teacher Guide” means the teacher guide document we send to Schools once they have registered.

Terms” means these terms and conditions.

Unplanned Event” means any act or event which is beyond our reasonable control, such as (by way of example, and without limitation) strikes, lock-outs or other industrial action by third parties; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack; war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence or other natural disaster; pandemic; epidemic; state funeral; failure of public or private utilities or telecommunications networks.

Website” means our website at www.youngvoices.co.uk (or any alternative website URL we use, if this changes).

you” (or “your”, depending on the context) refers to you, a user of our Website.

Young Voices” means Young Voices (UK) Limited, with registered office at Grove Mews, 1 Coronation Road, Birchgrove, Cardiff, CF14 4QY. In these terms the words “we”; “us” and “our” may also be used and refer to Young Voices (UK) Limited.

Young Voices Shop” means our online shop, hosted by third party host Shopify.

“YV Teacher Community” means the online community accessible on our Website and provided by Yammer.

Our Website is owned and managed, operated and maintained by Young Voices, save where certain functions on the Website are operated by third parties such as Shopify or Yammer.

If you have any comments, queries or complaints then you can contact us by writing to Young Voices (UK) Limited, Grove Mews, Cardiff CF14 4QY or by contacting us using the web chat feature.

2. Rights in and to Young Voices and our Website

The Intellectual Property Rights and all other rights in and to Young Voices, our Website and the content in it and all other information and materials which relate to Young Voices are owned by (or licensed to) Young Voices or its group companies. The content in our Website and materials is protected by copyright laws and treaties around the world.

Unless we agreed with you in writing, you will not (a) use, reproduce, copy, change or incorporate any part of our Website or any Intellectual Property Rights or other rights owned by or licensed to us into any other materials, or (b) do anything which may be seen to take unfair advantage of our goodwill or reputation or could be considered an infringement of any of the rights owned by or licensed to us.

You agree that you will not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Website or any services provided via, or in relation to, our Website. This includes using (or enabling, authorising or attempting the use of):

- Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Website or any data, content or services available on it.

- Any automated technique which is aimed at analysing text and data in digital form to generate information such as patterns, trends and correlations.

All our rights, including those which are protected by the Digital Copyright Directive ((EU) 2019/790), are reserved by us.

You also agree that you will not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.

Where our Website links to other sites and resources provided by third parties, you agree that we are not responsible for the content of those sites or resources. If you have any questions or concerns about anything contained in any third party sites or resources, please contact the relevant third party.

3. Privacy, data protection and cookies

We are committed to protecting your privacy and ensuring the correct and lawful treatment of personal information. You can click here to view our Privacy Policy, which explains how we process any personal data you provide to us and how we comply with relevant laws and regulations such as the UK GDPR and the Data Protection Act 2018.

4. Disclaimer and exclusion of liability

We make every effort to keep information on our Website up-to-date and correct. If you use our Website just for browsing and do not set up an account or make a purchase you do so at your own risk and other than as set out in these Terms, we will not be required to compensate you for any losses arising out of or in connection with your use of our Website. If you are interested in getting involved with Young Voices then we will provide further information and materials once your School is registered. If you have any questions before registering then please get in touch with us.

We may need to make changes to our Website or to suspend access to the Website, for example for repairs, planned maintenance or upgrades. While we will do our best to keep our Website available, we will not have to compensate you if we do need to make any changes or restrict access for any period of time. If you need to access a particular part of the Website which appears to be unavailable then please contact us.

We take all reasonable steps to keep our Website secure but unfortunately we cannot guarantee that the Website will be secure or free from bugs or viruses. You are responsible for configuring your own technology, computer programme and platform to access our Website and for use of your own virus protection software.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

5. General

We may make changes to these Terms. Each time you use our Website please check these Terms to make sure you understand the terms that apply at that time.

These Terms are a contract is between you and us. Nobody else can enforce that contract and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court or other authority decides that any of these Terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

If you are using our Website just to browse and you do not set up an account or make a purchase, sections 1-5 of these Terms reflect all of the terms that apply between you and us with respect to your use of our Website.

These Terms are personal to you and you can only transfer your contract with us to someone else if we agree to this.

We can transfer our contract with you, so that a different organisation is responsible for supplying any products you have purchased from us or otherwise providing the services we have offered. We'll ensure that the transfer won't affect your rights under the contract.

These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

6. Information about the Teacher Centre, School registrations and attendance at our concerts

The provisions in this Section 6 apply to users of the Teacher Centre, in addition to the terms set out in sections 1-5 above.

Our Teacher Centre provides a reference point for teachers and other school staff to access resources, register for our concerts and to purchase choir t-shirts and tickets for the concerts. These Terms apply alongside and in addition to the information given in our Teacher Guide and in other resources in the Teacher Centre, and we recommend that you read these Terms alongside those resources.

To access the Teacher Centre you will need create an account by providing an email address and choosing a password. You will also need to register your School. You can do this by following the instructions on the Website. Only one registration is permitted per School. To create your account, you will also have to confirm that you accept these Terms. If you do not do so you will not be able to use the Teacher Centre. Once your details have come through to us we will activate your registration and you will then be able to log in and to add teachers and other staff members to the account. You agree that you will be personally responsible for your login details and will not share this information with others.

6.1 Registration of Schools and concert allocations

You will need to pay a registration fee to register your School with us. Payment of this fee will give you a number of perks, as set out on our Website, and includes your School’s involvement in one of our concerts. You can find details of how to pay your registration fee in your Teacher Guide and on our Website.

Each School wishing to attend a Young Voices concert must be registered directly with Young Voices. This means that more than one school cannot share one registration. This ensures that we can plan our concerts accurately, and also helps us to easily identify schools in the case of an emergency and to ensure that every school that takes part will receive all our vital health and safety information before they attend.

Once you have registered your School, we will periodically provide relevant information and resources, either within your Teacher Centre or sent out to your School. This includes the Teacher Guide, which will provide information about the processes leading up to our concerts. You will also have the opportunity to book your School in for a particular concert date and location.

If you choose to receive an invoice from us before paying your registration fee, you will find the invoice in your Teacher Centre account. This must be paid in full within 30 days, or we will cancel the invoice and your registration, and your School will not be booked into any concerts.

We can only confirm your School’s inclusion in any concert once we have received full payment, and only then if there is availability for the particular concert. If you try to pay for your concert registration after a particular concert is already full then we will contact you to look at alternative options. You agree that we will not compensate you for lack of availability on any concert date.

If demand for our concerts means we need to operate a reserve list, we will not process any payment from your School until a space has opened on a particular concert date. We will also work with you to try and get your School to an alternative concert on a different date or even a different venue. You agree to co-operate with us as far as possible in these efforts.

If you don’t pick a concert date we will assign your School to a concert and will confirm the date and location once we have received full payment of your School’s registration fee. Your School is expected to attend the concert you have been assigned, so you agree to contact us promptly after we notify you of the date and venue, if you have any problem with the concert we have assigned your School to. We will not compensate you if your School attends the wrong concert.

If you want to change your School’s concert date you will need to notify us as soon as possible and any changes we agree will be subject to availability of an alternative concert date. We will not compensate you for any inability to change your concert date if an alternative is not available.

Once we have received registration fees we start work on preparing your School for our concerts straight away, including providing access to resources in the Teacher Centre, sending out Teacher Guides and sending out music books for the concert series. These resources are all valuable tools for schools and for this reason we are not able to refund registration fees. We will not send out any information, music or other materials until we have received full payment of registration fees and have confirmed your School’s inclusion in a concert.

We may charge interest on late payments. If for any reason we allocate your School to a concert and/or send out any resources to you before we have received payment, then if we're unable to collect any payment you owe us promptly we may charge interest on the overdue amount at the rate of 2% a year above the Bank of England base rate applicable at the time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You agree that you will pay us the interest together with any overdue amount.

6.2 Teacher workshops

Young Voices offers teachers the opportunity to attend workshops to help prepare choirs for our concerts. These can be booked via your Teacher Centre account. You can find details of how to pay for a workshop in your Teacher Guide and on our Website.

We can only confirm your School’s inclusion in a workshop once we have received full payment, and only then if there is availability for the particular workshop. If you try to pay for a workshop after it has reached capacity then we will contact you to look at alternative options. You agree that we will not compensate you for lack of availability for any workshops.

If you don’t pick a workshop date we will assign your School to a workshop and will confirm the date and location once we have received full payment of your School’s workshop fee. Your School is expected to attend the workshop you have been assigned, so you agree to contact us promptly after we notify you of the date and venue, if you have any problem with the workshop we have assigned. We will not compensate you if your School attends the wrong workshop.

If you want to change your School’s workshop date you will need to notify us as soon as possible and any changes we agree will be subject to availability of an alternative workshop. We will not compensate you for any inability to change your workshop if an alternative is not available.

All workshops must be paid for before the day of the workshop. We may have to turn away anyone who arrives at a workshop without having paid the workshop fee. Workshop fees are non-refundable.

We may charge interest on late payments. If for any reason we agree for your School representatives to attend a workshop when we have not received payment, then if we're unable to collect any payment you owe us promptly we may charge interest on the overdue amount at the rate of 2% a year above the Bank of England base rate applicable at the time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You agree that you will pay us the interest together with any overdue amount.

6.3 YV Teacher Community

The YV Teacher Community offers the opportunity for Schools to engage with each other and Young Voices staff and includes guidance from us as well as third party advice and insights that may be useful to other Schools. To set up an account and use the YV Teacher Community you will need to accept the YV Teacher Community Usage Policy and also confirm that you have read and agree to the Terms of Use which apply.

By using the YV Teacher Community you agree that:

- We are not responsible for advice given or comments made by anyone other than authorised Young Voices representatives. It is up to you to decide whether you choose to rely on views and opinions posted by third parties.

- You will not post any content which is harmful, threatening, abusive, vulgar, obscene, harassing, defamatory, offensive, promotes a political view or may otherwise be considered objectionable by a reasonable person.

- You will not post or transmit chain letters, pyramids or money schemes.

- You will not use your account to impersonate any person.

- You will not use your account to ‘spam’ by posting frequent and/or annoying messages.

- You will not post any content containing links to sites that open up multiple windows or to sites that contain material that would conflict with these Terms.

- You will not post content, which would infringe any rights of any third party. If you have been authorised to post any content owned by someone else, you agree to give credit where credit is due.

- You will not use the YV Teacher Community to offer items or services for sale or to advertise goods, products or services.

You acknowledge that if you breach any of the provisions set out in these Terms we may choose to remove your access to the YV Teacher Community. We may also choose not to publish any content that you post in our absolute discretion, bearing in mind our ethos and rules.

6.4 Final choir numbers

In order to make sure we allocate spacing for everyone, we have strict timelines for finalising choir and staff numbers from each School. You agree that you will submit your School’s final choir numbers to us by the deadline outlined in your Teacher Guide. If you have not confirmed final numbers by this deadline then we will take your approximate choir numbers as the final number and we will not compensate you or anyone else if you do not have enough spaces allocated for the concert, even if children or adults arrive at the concert and are turned away.

You also agree to notify us of any special seating/disability requirements at the same time as you confirm final choir numbers. Once we have finalised choir numbers we will not be able to accommodate any additional requests, and we will not compensate you or anyone else if we cannot accommodate any specific needs that were not brought to our attention before the deadline.

6.5 Permission slips

It is the responsibility of the teacher in charge to obtain a signed permission slip from all children in their respective choir for involvement in our concerts. We may ask Schools to supply all permission slips for our reference, and may also do so as part of our annual auditing procedures.

Permission slips must ensure that each parent/guardian agrees:

  • that their child may be filmed or photographed (or both) at the concert which they attend;
  • that their child’s performances at the concert may be recorded;
  • that Young Voices (and third parties authorised by Young Voices) may use that film, photograph and/or recording by any and all means and in any and all media, for profit or not for profit, throughout the world, for the life of copyright in the applicable film, photograph and recording and any extensions and renewals of copyright and where possible, in perpetuity;
  • that Young Voices may edit that film, photograph and/or recording as necessary for the purpose for which they are using the materials; and
  • that each parent/guardian waives, on behalf of themselves and the child for whom they are providing consent, all claims of any kind in connection with or which arise from the use by Young Voices (and third parties authorised by Young Voices) of that film, photograph or recording (as applicable).

If you have any filming objections then you agree to raise these with us as soon as possible, and in any event prior to the concert. When possible we will take reasonable steps to take account of your objections. This might include, for example, ensuring that no close-up images are taken of a particular child so that they cannot be easily identified. You acknowledge that a particular child may still appear in wide angle group images.

If at any time after an event you wish to have a child’s image removed from footage/photos/other materials then please get in touch with us and we will take reasonable steps to accommodate your request. You acknowledge that this may not always be possible, for example where we have already distributed event videos or materials which include the relevant images or footage. We will always try to find a reasonable solution for any reasonable requests.

6.6 End of concert procedures

We have worked hard to establish safe and efficient procedures for leaving our concerts. You agree to follow the instructions given by us within the Teacher Guide and as provided in the Teacher Centre or elsewhere, in relation to arrangements for after the concert, including our rules around leaving the concerts before they are finished.

It is your responsibility to ensure parents and guardians are clear about where they meet their children. While we welcome constructive feedback on our procedures, we are not responsible for:

  • any congestion or safety concerns created by schools leaving early
  • any arrangements made outside of our designated areas at a particular concert
  • arrangements made by teachers after the concert for parents to meet their children.
  • any complaints about collection procedures. These must be dealt with by your School.

6.7 Changes to concert programmes and unplanned events

We may alter or vary our concert programmes or reschedule or cancel all or part of any particular concert or concerts.

We will not be responsible, and will not compensate you or anyone else, for any failure to perform, or any delay in performance of, any of our obligations that is caused by an Unplanned Event.

6.8 Choir t-shirts and concert tickets

You can order choir t-shirts and concert tickets from us through your Teacher Centre account or via the order forms we provide. We provide information about the different options in your Teacher Guide, the Teacher Centre and elsewhere on our Website. We also confirm key information to you in writing after you order, either by email or within your Teacher Centre account.

We only accept orders when we've checked them. If you order via the Teacher Centre, your order will be saved in your Teacher Centre account and we will send you a payment confirmation once your payment has been reconciled and we’ve accepted your order. If you order via the paper order form we will send you an order confirmation by email, which will also provide details of when your order will be sent to you.

Sometimes we reject orders, for example, because a product is unexpectedly out of stock, because you are located outside any specified delivery areas stated on our Website or because a product was mispriced by us. When this happens, we will let you know as soon as possible and refund any sums you have paid.

We charge you when you order. You can see more information about payment options within the Teacher Centre and on our Website.

Orders will be subject to payment being made in full within 30 days of the relevant order. If we haven’t received payment in this time period then we will cancel your order and you will need to place a new order and pay in full. It is our policy not dispatch any merchandise or make any tickets available until we have received payment in full.

If you are buying concert tickets, you acknowledge that we work with the concert venues and ticket fulfilment companies to process and provide these tickets. Tickets may be provided in physical form or accessed in digital form, for example via an app. All necessary information about how to access tickets is included in the Teacher Guide or elsewhere on our Website. We strongly advise that you follow the guidance set out in the Teacher Guide relating to buying tickets and that you pay particular attention to order dates and prices. The price of tickets will depend on when and where you purchase them. We will not compensate you if a particular concert has sold out of tickets and/or tickets are more expensive than you expected when you come to purchase them.

We charge interest on late payments. If for any reason we agree to proceed with any order when we have not received payment, then if we're unable to collect any payment you owe us we may charge interest on the overdue amount at the rate of 2% a year above the Bank of England base rate applicable at the time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You agree that you will pay us the interest together with any overdue amount.

We pass on increases in VAT. If the rate of VAT applicable to sale of any particular product changes between your order date and the date we supply the product, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

We're not responsible for delays in providing goods which are caused by Unplanned Events. If supply of your product is delayed by an Unplanned Event, such as delays with merchandise providers or ticketing companies or delivery issues, we will contact you as soon as possible to let you know and will do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but if the delay is likely to be substantial you can contact us to end the contract and receive a refund for any products you have paid for in advance, but not received, less any reasonable costs we have already incurred.

Products can vary slightly from their pictures. A product's true colour may not exactly match that shown on your device or in the information we send out, or its packaging may be slightly different.

As t-shirts are made and printed for a particular concert series, we are not able to re-sell these and so once purchased you will cannot change your mind about your purchase, and unless any products are faulty, as set out below, t-shirt and ticket purchases are non-refundable.

You're responsible for making sure your measurements are accurate and you buy the correct size t-shirts. If you make a mistake with sizing then please contact us and we will do what we can to exchange your purchase for the correct size. You will be responsible for the cost of returning your original order, and for the delivery costs of the replacement t-shirts.

We may charge you additional sums if you don't give us information we've asked for or you provide inaccurate information, for example you provide the incorrect delivery address or we have to reschedule delivery because you have not made yourself available to take delivery.

You have rights if there is something wrong with a product you have bought from us. If you think there is something wrong with your product, you must contact us as soon as you become aware of there being a fault. We honour our legal duty to provide you with products that are as described to you on our Website and that meet all the requirements imposed by law.

We may change products and these Terms. We can always change a product to reflect changes in relevant laws and regulatory requirements, or to make minor technical adjustments and improvements. These are changes that won't affect your use of the product.

If we change any products in a way that will have a material effect on what you have paid for, or which require us to adjust the price, we will notify you and you can then contact us to end the contract and cancel your order before the change takes effect and receive a refund for any products you've paid for in advance, but not received.

We may suspend supply of any of our products. We may do this to deal with technical problems or make minor technical changes, to update the product to reflect changes in relevant laws and regulatory requirements, or to make changes to the product. If we do so, we will let you know, may adjust the price and may in some circumstances allow you to cancel your order (in which case we'll refund any sums you've paid in advance for products you won't receive).

We can end our contract with you in respect of any order, and claim any compensation due to us, if:

  • you don't make any payment to us when it's due and you still don't make payment within 30 days of our reminding you that payment is due;
  • you don't, within a reasonable time of us asking for it, provide us with any information or co-operation that we need to provide the product, for example, confirming shipment and delivery details or email addresses needed for provision of digital materials; or
  • you don't, within a reasonable time, either enable us to deliver the product to you or collect it from us.

We don't compensate you for all losses caused by us or our products. We're responsible for losses you suffer caused by us breaking this contract unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
  • Caused by an Unplanned Event, as long as we have taken the steps set out above in relation to Unplanned Events.
  • Avoidable. Something you could have avoided by taking reasonable action. For example, damage to your own digital content or device, which was caused by digital content we supplied and which you could have avoided by following our advice to apply a free update or by correctly following the installation instructions or having the minimum system requirements advised by us.
  • A business loss i.e. it relates to anything we sell to you for the purposes of your trade, business, craft or profession, which includes anything sold to your School in relation to its involvement with Young Voices and our concerts.

7. Young Voices Music Room

The provisions in this Section 7 apply to users of the Young Voices Music Room, in addition to the terms set out in sections 1-5 above.

The Young Voices Music Room is a private space for Schools and choir participants to access our resources. The Music Room gives children a fun and safe learning environment for all the songs and dance moves they need for their concert series, accessible at home, and offers teachers and parents the reassurance of a secure and appropriate platform for their child.

The Music Room is only for registered Schools and their choir participants taking part in Young Voices concerts. If you are a parent/guardian and would like access to the Music Room please ask for an invitation to set up your account from the teacher at your school who is in charge of your child’s Young Voices choir.

Whether you are a parent/guardian or a teacher or other School representative, in order to use the Music Room you will need to create an account and may also have to confirm that you accept these Terms and the Young Voices privacy policy. Once you have set up a Music Room account you can add your child to the account. You will be personally responsible for your Music Room login details and you agree that (a) you will not share this information with anyone else; (b) you will not use any of the information or content available in the Music Room for any purpose other than to assist your School/child in preparing for their Young Voices concert; and (c) you will not share any of the information or content available in the Music Room with anyone else. You also agree to explain to any children, for whom you create a profile in the Music Room, that they must not use any of the information or content available in the Music Room for any purpose other than to prepare for their Young Voices concert and must not share any of the information or content available in the Music Room with anyone else.

The Music Room provides a link to the Young Voices Shop where you can purchase various Young Voices merchandise and content, including video downloads of our concerts and official choir t-shirts. Purchases made in the Young Voices Shop are subject to additional terms and conditions which will be available within the Young Voices Shop.
